1. Introduction and Acceptance

Welcome to Eagan Data Solutions ("we," "us," or "our"). These Terms and Conditions govern your use of our website (the "Site") and all services offered by us, including Consulting, Product Development, and Training (collectively, the "Services").

By accessing the Site or engaging our Services, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, you must not use our Site or Services.

2. Services Offered

We offer the following core services, each governed by these Terms and any specific agreements (like a Statement of Work):

• Data Analytics Consulting: Providing strategic advice, audits, and analytical insights.

• Product Development: Custom building of digital tools and applications (e.g., automation scripts, custom dashboards, management software).

• Training and Workshops: Live, online, instructor-led training sessions.

• Self-Paced Online Courses: Digital content, modules, and resources available for purchase and on-demand access.

 

3. Client Engagement and Payment Terms

3.1. Consulting and Product Development:

All professional services will be initiated only after a formal agreement, such as a Statement of Work (SOW) or Master Services Agreement (MSA), is signed by both parties. The SOW will detail the fixed scope, fixed price, payment schedule, and specific deliverables.

3.2. Payment for Services:

Payment terms will be outlined in the SOW or course registration page. Unless otherwise agreed:

• Consulting projects require an upfront mobilization fee.

• Product Development projects are invoiced based on agreed-upon milestones.

• Training and Course fees must be paid in full prior to access or participation.

3.3. Project Results and Disclaimer:

Any case studies, testimonials, or example results presented on the Site are historical examples of past performance using our methodologies. Individual results are not guaranteed and will vary based on the client’s business context, market conditions, and level of internal engagement.

 

4. Intellectual Property (IP) and Ownership

4.1. Our IP (Pre-existing Content):

All content on the Site, including our methodologies, analytical frameworks, course content, documentation, text, graphics, and code (unless explicitly sold as custom work), is the property of Eagan Data Solutions and protected by copyright law. You may not copy, reproduce, or resell our pre-existing IP.

4.2. Client IP and Custom Products:

Upon final payment for a custom Product Development project, the Client will receive 100% ownership of the final source code and the intellectual property created specifically for that project. Eagan Data Solutions reserves the right to use non-confidential project experience to improve its internal methodologies.

4.3. Training Content:

All materials provided in our training and courses (live or self-paced) are for the sole use of the registered participant. These materials may not be shared, redistributed, or resold.

 

5. Training and Course Specific Clauses

5.1. Refunds and Cancellations (Live Training):

Refund policies for live training will be published on the registration page. Generally, full refunds are offered for cancellations made 30 days before the start date. No refunds are given for no-shows or cancellations within 7 days.

5.2. Refunds (Self-Paced Courses):

Due to the digital nature of the content, refunds for self-paced courses are only available if the user requests a refund within 3 days of purchase AND has completed less than 20% of the course content.

5.3. Course Access:

Access to self-paced courses is granted for a duration specified at the time of purchase (e.g., 1 year).

 

6. Website Use and Conduct

6.1. Prohibited Use:

You agree not to use the Site in any way that causes, or may cause, damage to the Site or impairment of the availability or accessibility of the Site. This includes using the Site to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, or other malicious software.

6.2. Accuracy of Information:

Any information you provide on the "Contact Us" or "Free Consultation Inquiry" form must be accurate, current, and complete.

 

7. Limitation of Liability

Eagan Data Solutions will not be liable for any consequential, indirect, or special loss or damage, including loss of profit, loss of revenue, or loss of business opportunity, arising out of or in connection with the use of this website or reliance on any general information provided on it.

 

8. Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of United Arab Emirates. Any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Sharjah.

 

9. Changes to Terms

We reserve the right to revise and amend these terms and conditions from time to time. The date of the latest update will be visible at the top of this page. Your continued use of the Site after any changes are published constitutes your agreement to be bound by the revised terms.
